  • The responsibility for proving prior professional experience lies with the employee, who must provide work certificates or attestations.

Disputing an absent or incorrectly calculated technical bonus

The first step is to compare your payslip with the collective grid. Identify your group (A2), your technical level, and the indexed coefficient. If the “technical bonus” line is absent or if the amount seems lower than what the agreement provides, you have a lever.

Send a written request to your employer citing article 08.01.1 of CCN 51. Attach your proof of professional experience in the job. The employer is required to apply the collective provisions, and a simple administrative oversight can often be corrected at this stage.

If the response is unsatisfactory or absent, several recourses exist:

  • Contact the employee representatives or the union delegate of your organization, who can raise the issue in a meeting.
  • Contact the labor inspectorate to report a breach of the applicable collective agreement.
  • As a last resort, bring the case to the labor court. The employee can claim a back bonus for the last three years, in accordance with the statute of limitations for salary matters.

You have been performing A2 executive responsibilities for several years, but your contract still mentions a different group. The most useful reflex remains to confront your coefficient, your technical level, and the rate applied each month with the current grid. A discrepancy, even minor, can accumulate over several years and represent a significant salary recall.
